TERMS & CONDITIONS OF BUSINESS
PLEASE NOTE THAT ALL PROFESSIONAL DRIVING SCHOOLS SHOULD SUPPLY YOU WITH A TERMS AND CONDITION OF BUSINESS!!
- The cost of driving lessons will have been clearly explained upon first contact with MSM. The pupil will also be clearly informed at the beginning of the first lesson.
- Each driving lesson must be paid for at the start of the lesson and the lesson duration is approximately 1 hour.
- The meeting point for each lesson is at either the Douglas Bus Station car park or Douglas Sea Terminal car park. If a pupil requires to be picked up at any other destination then the travelling time from either of the pickup points above to that destination may infringe into the pupils lesson time at the beginning and the end of the pupil’s lesson.
CANCELLATION OF LESSONS
- A minimum of 24 hours notice must be given to MSM or the Instructor for no charge to occur. If you fail to turn up for an appointment and no cancellation notice was provided to your Instructor before the start of the lesson, then a full charge of the lesson will be payable.
- If a lesson is cancelled within 24 hours, the lesson price will be charged after a discount of 25%.
- If any lessons paid for in advance or with vouchers are cancelled within 24 hours, then the full amount of a lesson will be charged.
- Whilst waiting at the meeting point for your lesson please look out for your Instructor. He/she will wait at the agreed pickup point for 15 minutes only. If you fail to attend you will be charged the full cost of a lesson. If you are running late beyond 15 minutes please call or text your instructor to inform them so you do no miss the remaining time of your lesson.
- MSM will endeavour to give a pupil prior notice if any changes or cancellations need to be made to a pupils lesson. MSM reserves the right to postpone lessons if it is felt that the weather or road conditions are unsuitable or dangerous. MSM cannot be held responsible for any costs incurred as a result of the postponement of any lessons, for whatever reason.
GENERAL TERMS
- You must have a valid (NOT expired) two part Isle of Man provisional driving licence which must be produced to the Instructor at the start of the first lesson. If you hold a full licence and are taking refresher lessons or advanced driver training, this licence must also be valid but does not necessarily need to be a Manx driving licence.
- All pupils must be able to read a vehicle registration plate from a distance of 20.5 metres with the use of glasses or contact lenses if appropriate. Please ensure that glasses or contact lenses are worn during your lessons if you are required by law to wear them for driving. If a pupil is required to wear glasses or contact lenses whilst driving and he/she fails to bring them to the lesson, no driving will legally be allowed to take place, therefore the instructor at this point will offer you the option to run through theory training with you. If this is refused the lesson will still be charged for at the full amount.
- In the interests of the Pupil and public safety MSM reserves the right to withhold the use of a car for the test if, in their opinion, the pupil’s driving is actually unsafe or potentially dangerous.
- At the Instructor’s discretion, a pupil may be refused entry into the driving school vehicle if they turn up for their lesson with soiled clothing or muddy work boots. The lesson will have to be paid for at the full amount.
- Any pupil may be refused a driving lesson if the Instructor has reason to believe that the pupil is under the influence of alcohol or drugs and the lesson will still be charged for at the full amount.
- The Instructor may refuse to carry on giving a pupil driving lessons without notice if the Instructor is not satisfied with a pupil’s conduct or commitment throughout lessons.
- At the instructor’s discretion, any pupil who cancels lessons on three or more consecutive occasions could lose their time allocated to them. This will not be the case if a pupil is on holiday and MSM has been given prior notice.
- All Instructors working under the MSM banner as a franchise instructor are classed as being self employed instructors, therefore if a pupil pays for any driving lessons in advance directly to their instructor and not via the MSM office, then the agreement for those lessons will be between the pupil and the instructor. MSM will not be responsible or liable for any lessons paid for in advance if all monies have been paid directly to the instructor.
- Any lessons paid for in advance via MSM or directly to the Instructor will not be refunded if the pupil for whatever reason decides to stop taking lessons. If a pupil stops taking lessons because of any personal issues between themselves and the Instructor, then the pupil will be allocated to another MSM Instructor to complete and continue with their lessons.
- A free controls lesson will only be offered to new customers who have not driven a vehicle before. If a pupil has had previous driving lessons or private practice, before starting with MSM, then the controls lesson will not be offered. Controls lessons are a stationary lesson explaining the safety precaustions on entering and exiting the vehicle and the use of the main controls, no driving takes place during this lesson. The controls lesson will last for approximately 30 minutes.
- All promotions offered by MSM are subject to change without prior notice.
- All promotions are all subject to terms and conditions which will be clearly explained during the promotion.
- When a pupil pays for the 10 lessons in advance promotion and then receives 11 lessons, the 11th lesson will be classed as nil and void if the pupil decides to cancel or discontinue with the lessons at any point. If lessons are postponed by the pupil for a period of 30 days or more, the 11th lesson may not be used.
- Blocks of lessons paid for in advance must be completed within 6 months from the date of the first lesson taken. If a pupil decides to postpone lessons that have been paid for in advance then the remaining lessons must still be completed within 6 months. No outstanding lessons paid for will be refunded.
- Blocks of lessons or money paid for in advance must be used within 6 months from date of purchase. On the expiry of 6 months from date of purchase any lesson not used will be nil and void. No credit or refunds will be given.
- Blocks of lessons or money paid in advance will not be refunded if a pupil takes a driving test and successfully passes before the test before the block of lessons have been completed. Any lessons remaining that have been paid for in advance may not be passed onto another pupil.
- In the interests of comfort and safety learners are advised to wear suitable footwear and clothing which does not restrict movement. Learners must also take note of any medication they are taking that may affect their ability to drive safely and/or advise their instructor accordingly before taking any lesson booked.
- Due to increasing annual costs of insurance, maintenance and fuel, the cost of driving lessons will normally be increased at the beginning of each financial year advance notice of which will be given to the pupil.
- If you are taking on-road lessons, the Instructor will carry the appropriate motor insurance should the pupil cause an accident as a learner whilst driving the Instructor’s tuition vehicle, whether accompanied by an Instructor or an Examiner.
- We do not guarantee to provide, or procure the provision of, services if we are prevented from doing so in circumstances beyond our reasonable control, including without limitations, the activities of civil or government authorities, third party industrial disputes, internal industrial disputes where we have taken reasonable steps to prevent the effects of such action on our services but have been unable to do so; acts of God; or severe weather conditions.
VOUCHERS
- All vouchers are non refundable under any circumstances. A voucher must be presented at the start of a lesson, failure to do so will incur the standard lesson charge by additional payment. The value of a voucher may not necessarily cover the cost of a driving lesson; an additional charge may occur to make up the full lesson price. Vouchers are only valid for 6 months from date of purchase. Expired vouchers will not be accepted beyond the expiry date. Lost vouchers can be replaced as per the initial validity date. Administration charges apply to replace vouchers.
- Any lessons not taken with the use of vouchers after the voucher expiry date will not be accepted or refunded.
- Voucher numbers and expiry dates are clearly displayed on either the front or reverse of the voucher.
- MSM will not be liable or responsible for any promotion vouchers issued if their Instructor can no longer carry out driving lessons or if the Instructor ceases to be associated or work under the name of MSM.
- MSM recommend that lessons are booked at least 2 months before the expiry of the vouchers therefore allowing time to complete all voucher lessons. Lesson are subject to availability only and if you call within only 2 months before vouchers expire, MSM cannot guarantee that there will be availability to complete the use of all vouchers.
- Vouchers cannot be transferred to another persons name from the name that was initially listed with the MSM office when the vouchers were purchased.
- Promotional vouchers are subject to additional terms and conditions and may not be used in conjunction with any other promotion. Terms and conditions will be supplied with the vouchers.
THE DRIVING TEST
- All pupils must pass a computerised theory and hazard perception test before they can be entered for a practical driving test.
- If a pupil has entered for a driving test and does not keep up to date with their lessons prior to the test, then the Instructor may refuse the pupil the use of the vehicle for the test without notice.
- If a pupil applies for a driving test without the prior consent of the Instructor and the Instructor does not think that the pupil in question is not at test standard, then the pupil will be refused the use of the driving school vehicle for the test.
- On the day that a pupil takes a driving test, it is standard practice to have a pre test lesson and then use the vehicle for the driving test. Therefore the vehicle has to be booked for two hours thus making a total charge of two hours. The cost for the two hours must be paid for at the start of the pre hour or the instructor reserves the right not to take you for the test. If a pupil has the first test on that particular day and they feel they do not need to have a pre test lesson, then they are required to meet the Instructor at the Vehicle Testing Centre at 10 minutes prior to the test.
- If you are successful in passing the driving test, you may be asked by your instructor for consent to have your photograpgh taken, so that it may be download onto the MSM website photo gallery for promotional reasons. When verbal consent has been provided by the pupil or by the legal guardian of the pupil, the photo will then be added to the website. If a pupil requests in writing, for a photo to be removed, an administration charge of £50 will be applied to carry out this service. The administration charge is payable in advance of the work being carried out to remove the photo from the website.
